Yes... DUI Marijuana is a problem because you can't really tell with a blood test whether the person smoked an hour ago or two days ago and this would open the door for many court suits and would probably end up in the Supreme Court of the USA.

Personally, I think that there should be some sort of license for marijuana users where they agreed that if they were licensed users of the weed, that they wouldn't be able to hold valid driver's licenses.

But I'm sure some lawyer has a better solution than that.

I would think if you got caught DRIVING too many times standard DUI laws would bump it up.

1977  I'm sure the laws are more lenient since then... but possession can still be a felony if you get caught too many times.

It does in Oklahoma.  It is a misdemeanor drug conviction on you record forever, unless you get a deferred sentence.  It stops people from getting into RN school and other fields of study.

I'm not sure if it will be as bad as that...  Most people aren't really heavy users of any of the drugs they come in contact with... addiction starts before the drugs go in.  It is a medical problem, not a moral one.

Depends on the state.  Weed is a minor misdemeanor in Ohio and not a jailable offense for personal use amounts.  Don't ask me the amount because I don't remember, but 200 grams sounds close.  With more serious drugs on a first time offense you can get it down to a misdemeanor if you haven't acted a fool during the arrest process and then go to counseling.  Nobody want drug users in jail, just drug peddlers.

Yes, I think the relative decriminization of small possession amounts has helped that a lot. I don't know, maybe you can tell me for small possession amounts I know you get arrested and fined, but does it go on your permanent record?

I don't have a problem with that. Perhaps removing the prohibition against these things will decrease the crimes committed; kinda like when they did away with alcohol prohibition.

I would argue that there are probably very few people in prison for smoking, eating, or shooting up politically incorrect substances.  They are in prison for selling them, stealing peoples belongings to buy them, murdering people while under the influence of them, and to make their territory larger.  But I would challenge you to find me somebody in jail for just doing them.  If there is is list it's gotta be pretty small.

My point was that a huge percentage of the prison population in this country are people who ingest substances that are politically incorrect. Perhaps we should reconsider the idea that the government gets to tell you what you can smoke/eat/shoot up/etc.

Well, this wasn't just a little doobie smoking.  And it wasn't "the next day" when they whacked them.  They did the crime in 1998, stole a cargo ship and killed the crew of 23,  were caught and tried in '99, and 13 of them were whacked in January of 2000.  They don't spend a lot of time on appeals in China.
